SMS MOBILE MESSAGE MANAGEMENT PROGRAM TERMS AND CONDITIONS

Last revised: September 26, 2026

Pirozzi's Italian Deli (“Pirozzi's”, “we”, “us” or “our”) offers an optional text message program (the “Program”) so that our customers can hear about our specials, events and news. We run the Program with the help of our messaging service provider. By joining or taking part in the Program, you agree to these SMS Program Terms and Conditions (the “Program Terms”), including the agreement to settle disputes through binding, individual arbitration described under “Dispute Resolution” below. These Program Terms apply only to the Program. They do not change any other terms that govern your relationship with Pirozzi's, such as the terms for online ordering or catering.

User Agreement to Receive Text Messages

When you opt in, for example by ticking the text message box on one of our forms or by texting a keyword to our number, you agree to receive recurring marketing and informational text messages from Pirozzi's Italian Deli, sent by us or on our behalf through our messaging service provider, at the mobile number you gave us and at any new or updated number you later provide. These Program Terms apply no matter how you joined the Program. Messages may be sent using automated technology. Your consent to receive marketing text messages is not a condition of buying anything from us. Messages may include specials, promotions, event announcements and instructions on how to manage your subscription. Our use of automated technology to send some messages does not mean that every message you receive is sent by an automatic telephone dialing system as defined by law. Message frequency varies. Message and data rates may apply.

User Opt Out

You can leave the Program at any time. Reply STOP to any message you receive from us (CANCEL, END, QUIT, UNSUBSCRIBE and similar words also work). We will send one final text to confirm that you have been unsubscribed, and you will receive no further marketing messages after that unless you join again. It may take a short time for your request to be processed, and a message that was already on its way may still reach you. Replying STOP from the phone that receives our messages is the quickest and most reliable way to opt out, but you may also tell us by email or by phone that you want to stop, and we will honor any reasonable request as soon as we can.

Duty to Notify and Indemnify

If you cancel, change or give up the mobile number you enrolled in the Program, for example by ending your phone plan or transferring the number to someone else, please reply STOP from that number before you stop using it, or let us know about the change by email. Keeping us informed is an important part of these Program Terms, because it helps make sure our messages do not reach a person who has not agreed to receive them. If you stop using your number without telling us and the new user of that number brings a claim because of messages we sent to it, you agree to be responsible for the reasonable costs, including attorneys’ fees, and the liabilities that we, our messaging service provider or anyone helping to deliver the messages incur as a result. This obligation continues after you leave the Program.

TO THE FULLEST EXTENT ALLOWED BY LAW, YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS PIROZZI'S ITALIAN DELI AND ITS MESSAGING SERVICE PROVIDER FROM ANY CLAIM OR LIABILITY THAT RESULTS FROM YOUR FAILURE TO NOTIFY US AS DESCRIBED IN THIS SECTION, INCLUDING ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, AND SIMILAR FEDERAL OR STATE LAWS AND REGULATIONS, ARISING FROM OUR MESSAGES TO THE MOBILE NUMBER YOU PROVIDED.

Program Description

Members of the Program receive messages about Pirozzi's Italian Deli, including daily and weekly specials, new menu items, catering offers, events, promotions and occasional service updates. We may also send a message confirming that you have joined and occasional reminders of how to get help or opt out.

Cost and Frequency

Message frequency varies, and you may receive several recurring messages a month. Pirozzi's does not charge for the Program, but message and data rates from your wireless carrier may apply.

Support Instructions

For help with the Program, reply HELP to any message from us, email pirozzisdeliinc@gmail.com or call the deli at (310)-548-0000. Please remember that the quickest way to stop messages is to reply STOP from the phone that receives them. Our Privacy Policy explains how we collect, use and protect your information.

Our Disclaimer of Warranty

The Program is provided “as is” and “as available.” It may not be available in every area or at all times, and it may stop working if your wireless carrier changes its products, software or coverage. Wireless carriers are not liable for delayed or undelivered messages. Neither Pirozzi's Italian Deli nor our messaging service provider is responsible for any delay in, or failure of, the delivery of a message, because delivery depends on your carrier’s network and on other factors outside our control.

Participant Requirements

To take part you must be the account holder or an authorized user of a mobile device that can send and receive text messages, and your wireless carrier must support the Program. Not every carrier or plan supports text messages from businesses like ours. Please check with your carrier or your device’s instructions if you are unsure. The carriers that support the Program may change without notice, and your carrier may block or limit messages sent from business numbers or short codes.

Age Restriction

You must be at least thirteen (13) years old to join the Program. If you are at least thirteen (13) but under eighteen (18), or under the age of majority where you live, you may join only with the permission of your parent or legal guardian, who agrees to these Program Terms on your behalf. By joining the Program, you confirm that you meet these age requirements and that the laws that apply to you allow you to take part. We may remove any number from the Program if we believe these requirements have not been met.

Prohibited Content

You agree not to use the Program to send us or anyone else any prohibited content. Prohibited content includes:

Anything fraudulent, defamatory, threatening, harassing or abusive; profanity, obscene material or content that promotes violence, hatred or discrimination based on race, sex, religion, national origin, disability, sexual orientation or age; viruses, malware or any other harmful code; offers for products, services or activities that are illegal where the message is received; personal health information protected by the Health Insurance Portability and Accountability Act (“HIPAA”) or the Health Information Technology for Economic and Clinical Health Act (“HITECH” Act); and any other content that is prohibited by the law that applies where the message is sent or received.

Dispute Resolution

Please read this section carefully because it affects your legal rights. Any dispute, claim or controversy between you and Pirozzi's Italian Deli, or between you and our messaging service provider or any other company that sends Program messages on our behalf, that arises out of or relates to the Program or these Program Terms (including claims under federal or state statutes, common-law claims, and questions about the scope, enforceability or validity of this agreement to arbitrate) will be resolved by final and binding arbitration, except that either party may bring an individual claim in small claims court if it qualifies.

Before either of us starts an arbitration or a small claims case, we agree to try to resolve the dispute informally. The party with a concern will send the other a written notice that describes the dispute and the relief requested (you can email pirozzisdeliinc@gmail.com or write to Pirozzi's Italian Deli, 1453 West 8th Street, San Pedro, CA 90732), and both of us will make a good-faith effort to resolve it within thirty (30) days. If the dispute is not resolved in that time, either party may begin arbitration. You may opt out of this agreement to arbitrate by sending us a written notice within thirty (30) days after you first join the Program; opting out does not affect any other part of these Program Terms.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect and will be heard by a single neutral arbitrator. This agreement to arbitrate is governed by the Federal Arbitration Act (“FAA”); in all other respects these Program Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Unless you and we agree otherwise, the arbitration will take place in Los Angeles County, California, or by video or telephone. Fees will be paid as the AAA rules provide, and the arbitrator may award attorneys’ fees only where a statute or contract allows it. The arbitrator’s decision is final, and judgment on it may be entered in any court with jurisdiction, subject only to the review the FAA permits. Claims may be brought only on an individual basis and not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine the claims of more than one person. If any part of this section is found to be unenforceable, the rest of it will remain in effect. If a dispute nevertheless proceeds in court rather than in arbitration, you and we each waive the right to a jury trial. This section survives the end of your participation in the Program.

Miscellaneous

You confirm that you have the right and authority to agree to these Program Terms and that doing so does not conflict with any other agreement you are bound by. If we do not enforce any part of these Program Terms, that does not waive our right to enforce it later. If any provision is found to be invalid or unenforceable, it will be limited or removed only as much as necessary, and the remaining provisions will stay in full force and effect. New features or changes to the Program are covered by these Program Terms unless we say otherwise in writing. We may update these Program Terms from time to time. When we do, we will post the new version on this page and change the “Last revised” date above, and we may also tell you about important changes by text message. Please review this page from time to time. If you keep taking part in the Program after an update, you accept the updated Program Terms. If you do not agree, reply STOP to leave the Program. We may change, suspend or end the Program, or any part of it, at any time. These Program Terms, together with our Privacy Policy, are the entire agreement between you and us about the Program. You may not transfer your rights under these Program Terms to anyone else, but we may transfer ours as part of a sale or reorganization of our business. Section headings are for convenience only and do not change the meaning of these Program Terms.
